The US Senate failed to advance the cryptocurrency regulatory bill Clarity Act before the August recess last weekend, significantly cooling market expectations for a swift implementation of the legislation. As lawmakers enter the recess period, the originally scheduled vote has been postponed, leaving the bills progress during the brief September session as the key uncertainty. Although this does not mean the legislation has completely failed, the window for crypto regulatory reform is narrowing as the midterm elections approach.
At present, the main obstacle preventing the bill‘s advancement is not the technical regulatory framework itself, but political disagreements surrounding conflicts of interest involving public officials. Senate Democrats are seeking stricter ethics provisions in the bill, including a ban on the president, members of Congress, and their family members from profiting through crypto-related businesses. The demand is largely driven by concerns over potential conflicts of interest and abuse of power following the Trump family’s involvement in multiple digital asset projects in recent years.
The Republican proposal was to restrict elected officials and their spouses from issuing or promoting digital assets, with enforcement oversight handled by the Department of Justice. However, Democrats argue that this arrangement lacks sufficient independence and want enforcement authority transferred to state attorneys general to prevent potential regulatory bias within the federal government. Disputes over enforcement responsibility and the scope of application have prevented both sides from reaching an acceptable compromise.
President Trump recently stated that, if necessary, related crypto asset arrangements could be placed into a blind trust, while emphasizing that such matters are mainly managed by family members. However, analysts believe the White House‘s stance remains the decisive factor in determining the bill’s future. If the ethical requirements proposed by Democrats fail to gain acceptance from the Trump camp, negotiations could remain deadlocked, making it difficult for Republicans to push the bill through independently.
In addition to disagreements between Democrats and the White House, there are also differing views within the Republican Party over the direction of crypto regulation. Some Republican senators are concerned that new digital asset rules could weaken the traditional banking system, particularly as stablecoin-related policies may encourage funds to move from community banks into digital asset platforms, potentially affecting local financial institutions deposit bases and lending capacity.
Over the coming weeks, the industry will continue to monitor the short congressional session after lawmakers return in September. At that time, legislators will have only around three weeks to address a large backlog of issues, including government funding, other regulatory policies, and election-related matters. With multiple priorities competing for attention, even if the Clarity Act resumes its legislative process, it may still face challenges in moving forward quickly. The final outcome may depend on political coordination during the final stage of negotiations.
